Terms of Use

1. Acceptance of terms

By accessing or using the HabitatsIQ platform at habitatsiq.com.au (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Platform.

These Terms constitute a legally binding agreement between you and HabitatsIQ Pty Ltd (ACN XXX XXX XXX) ("HabitatsIQ", "we", "us", or "our").

2. About the Platform

HabitatsIQ is an Australian property intelligence platform that enables users to:

• Search and browse residential property listings for sale and rent.
• Access automated market analysis, suburb insights, and property reports.
• Connect with licensed real estate agents and brokers.
• Generate buyer reports and floor plan estimates for specific addresses.

The Platform is intended for use by Australian residents aged 18 and over. Access to certain features requires a paid subscription or professional membership.

3. User accounts

3.1 Registration

To access features beyond basic property search, you must create an account. You agree to provide accurate, complete, and current information and to keep it up to date.

3.2 Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@habitatsiq.com.au if you suspect any unauthorised access.

3.3 Agent and broker accounts

Accounts registered as agents or brokers must belong to a licensed real estate professional. By registering as an agent or broker, you represent and warrant that you hold a current, valid real estate licence in the relevant Australian state or territory. We reserve the right to verify your licence and suspend or terminate accounts that do not comply.

4. Memberships & billing

4.1 Subscription tiers

HabitatsIQ offers the following access tiers:

4.2 Billing and renewal

Subscriptions are billed in advance. Monthly subscriptions renew automatically each month; annual memberships renew each year. All prices are in Australian dollars and include GST where applicable. Payments are processed securely by Stripe.

4.3 Cancellation and refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not provide refunds for partial periods except where required by the Australian Consumer Law. Annual memberships may be refunded on a pro-rata basis within 14 days of purchase if no premium features have been used.

4.4 Price changes

We reserve the right to change subscription prices. We will provide at least 30 days' written notice before any price increase takes effect. Continued use of the Platform after the effective date constitutes acceptance of the new pricing.

5. Property listings

5.1 Accuracy

Agents and brokers are solely responsible for the accuracy, completeness, and legality of the property listings they submit. You must not include false, misleading, or fraudulent information in any listing.

5.2 Licence to display

By submitting a listing or photo to the Platform, you grant HabitatsIQ a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the Platform and in related promotional materials for as long as the listing is active.

5.3 Compliance

All listings must comply with applicable Australian legislation, including but not limited to the Australian Consumer Law, state-based property advertising laws, and anti-discrimination legislation. We reserve the right to remove any listing that we determine, in our sole discretion, to be non-compliant.

6. Market analysis & reports

• Estimated property values are automated model estimates, not formal valuations by a licensed valuer.
• Floor plan data and room layouts are estimates only and may not reflect the actual configuration of a property.
• Historical and projected growth figures are based on available market data and are not guaranteed.
• Infrastructure and government project information is sourced from publicly available data and may be incomplete or subject to change.

You should always conduct your own due diligence and obtain independent professional advice — including from a licensed real estate agent, financial adviser, mortgage broker, or registered property valuer — before making any property decision.

7. Acceptable use

You agree not to use the Platform to:

• Submit false, misleading, fraudulent, or defamatory content.
• Scrape, crawl, or harvest data from the Platform by automated means without our written consent.
• Reverse-engineer, decompile, or attempt to extract the source code of the Platform.
• Transmit spam, malware, or any content that infringes third-party intellectual property rights.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Engage in any activity that interferes with or disrupts the Platform or its servers.
• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.

Breach of this section may result in immediate suspension or termination of your account.

8. Intellectual property

All content on the Platform — including the HabitatsIQ name, logo, design, text, software, and reports — is owned by or licensed to HabitatsIQ and is protected by Australian and international copyright and trademark law.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal or professional property-search purposes only. You must not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.

Content you upload (profile photos, listing images) remains your property, subject to the licence granted in Section 5.2.

9. Disclaimers

To the maximum extent permitted by law:

• The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.
• We do not endorse, verify, or guarantee any property listing, agent, broker, or third-party service accessible via the Platform.
• Nothing on the Platform constitutes financial, investment, legal, or valuation advice.

Certain consumer guarantees under the Australian Consumer Law cannot be excluded. Where the Platform is supplied as a service to a consumer, our liability for failure to meet a consumer guarantee is limited to re-supplying the service or paying the cost of having the service re-supplied.

10. Limitation of liability

To the maximum extent permitted by law, HabitatsIQ (including its directors, employees, and agents) will not be liable for any:

• Loss of profits, revenue, data, goodwill, or business opportunities.
• Indirect, incidental, special, consequential, or punitive damages.
• Loss or damage arising from your reliance on any market analysis, report, or estimate provided on the Platform.
• Loss or damage caused by a third party (including agents, brokers, or property sellers).

Where liability cannot be excluded, it is limited to the greater of AUD $100 or the total subscription fees you paid to us in the 12 months preceding the event giving rise to the claim.

11. Indemnity

You agree to indemnify, defend, and hold harmless HabitatsIQ and its officers, directors, employees, and agents from and against any claims, damages, losses, costs (including reasonable legal fees), and expenses arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; or (c) your violation of any third-party right, including intellectual property or privacy rights.

12. Termination

We may suspend or terminate your access to the Platform at any time and without notice if we reasonably believe you have breached these Terms or engaged in fraudulent, abusive, or unlawful conduct. You may close your account at any time via account settings. Upon termination, your right to use the Platform ceases immediately. Sections 8–11 and 13 survive termination.

13. Governing law

These Terms are governed by the laws of the State of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia for the resolution of any dispute.

14. Changes to these Terms

We may update these Terms at any time. We will post the revised Terms on this page with an updated "Last updated" date. For material changes, we will provide at least 14 days' notice via email or a prominent notice on the Platform. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
